Challenging Minds Terms of Service

By accessing our website you agree to the terms and conditions that are set out here. If you do not agree you have no right or license to access this website and you should not do so. These terms and conditions may change at our discrecion at any time and without notice. All orders and purchases made through this site are also governed by these terms and conditions.

We may change or update information on this website at any time without notice, including prices and stock availability. Information regarding sizes and weights of products are only approximate.  All products listed are in Canadian dollars and all transactions will be processed in Canadian dollars. Customers agree to pay all charges payable for their order. Challenging Minds reserves the right to limit the quantity of items that a customer may buy. In addition, Challenging Minds reserves the right to cancel orders at its discretion.

Challenging Minds will deliver its orders as quickly as possible, and within the suggested shipping times. All items are shipped through a third-party.  However, we are not responsible for delivery delays beyond our control.  Challenging Minds reserves the right not to ship to certain addresses.

Limited Liability

Challenging Mind’s liability is limited to the purchase price of the products sold. This website should be accessed and used at your own risk.  No guarantees can be made that the website’s content is accurate and error free at all times.  We will correct mistakes that are noticed as soon as possible and notify affected users. For example, this could mean that orders that have not been shipped may be cancelled.

Orders and Payment

Challengingminds.com must receive payment before it will accept an order. The only exception to this is in the case when challengingminds.com has a prior agreement with a customer to accept payment through a purchase order and issue an invoice to the customer for payment.  Payment is due prior to shipment. You agree to pay the amount(s) due as specified on the invoice.

Governing Law and Jurisdiction

Any dispute arising out of or related to these Terms and Conditions or the sales transaction between challengingminds.com and the Customer shall be governed by the laws of Canada, without regard to its conflicts of law rules. Challengingminds.com and the Customer consent to the exclusive jurisdiction and the venue of the Courts of Canada. In addition, the Customer also agrees not to bring any legal action against challengingminds.com that is more than one year after the date of the applicable invoice.
